Terms of Service

The agreement

These terms are between you and MASM Studios, the operator of Upshot (upshot.masmstudios.com). By creating a workspace or using a board, you accept them. If you're accepting on behalf of a company, you confirm you can bind that company.

The service

Upshot provides feedback boards, voting (including revenue-weighted voting), roadmaps, changelogs, an embeddable widget, and related tools. We may improve or change features over time; we won't materially reduce what a paid plan includes mid-billing-period.

Your content

• You own the content in your workspace — requests, votes, comments, branding. We claim no rights to it beyond what's needed to run the service.
• You're responsible for content posted to your boards and for moderating them. We may remove content that is illegal, abusive, or harms the service.
• If you connect third-party credentials (e.g. a Stripe key), you confirm you're authorized to share them and can revoke them at any time.

Acceptable use

Don't use Upshot to spam, harass, infringe others' rights, distribute malware, probe or disrupt the service, or misrepresent who you are. We may suspend workspaces that do.

Billing

• Payments are handled by Polar as merchant of record; Polar's checkout terms apply to the transaction. Prices are listed on the pricing page.
• Pro trials are free and require no card. When a subscription ends or lapses, over-limit boards are locked (hidden from the public) — never deleted — and unlock instantly on re-upgrade.
• You can cancel anytime; paid features remain active until the end of the billing period.

Service quality

Upshot is provided “as is”, without warranties. We aim for high availability but don't guarantee uninterrupted service. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Termination

You can delete your workspace at any time by emailing support@masmstudios.com. We may terminate workspaces that violate these terms, with notice where practical.

Changes

We may update these terms; material changes will be announced to workspace admins by email at least 14 days before they take effect. Continued use after that means acceptance.
